Pursuant to the ERMA Memorandum of Coverage, Section II, 6, “Defense Costs shall not include investigation costs incurred by investigators or adjusting expenses that were not approved by ERMA prior to the costs being incurred.”

Accordingly, ERMA’s Resolution 3-2007 permits a member to select an investigator if an outside investigation process is warranted.  If an investigation pertains to an ERMA matter, you must first report the claim to ERMA and obtain approval from the Litigation Manager prior to engaging an investigator in order for any expenses to count toward your Self-Insured Retention.  The member should provide the desired investigator’s CV or resume to the Assistant Litigation Manager, Rebecca Lane, prior to retention.  Upon approval of the investigator by the Litigation Manager, the member will be provided a form “Scope of Investigation” letter which will set forth the parameters of the investigation.  The ERMA Investigators list is provided as a resource for members when choosing a workplace investigator.  Approval of an investigator is done on a claim by claim basis; approvals are not universal and apply only to the applicable claim.
